Determination of Heirship Attorney in Plano,TX

Attorney John F. Williams, Jr. Can Help You with Determination of Heirship and Probate

Determination of Heirship Attorney in Plano,TXA Determination of Heirship is simply an action filed by a relative or friend on behalf of a deceased person who has failed to leave a Will or Living Trust identifying heirs to the estate.

When there isn’t a possibility of locating a Will (holographic or attorney drafted) the Determination of Heirship is filed separately in Probate Court and separate of the petition for Administration. Unlike an Affidavit of Heirship, the Determination of Heirship must be dealt with through the Court system.

The Court will order the appointment of an attorney ad litem to represent the “unknown heirs”. The attorney locates and identifies heirs for the court and the administrator appointed to handle the affairs of the deceased individual’s estate.

Once this has taken place, then the court will allow the probate process to move forward towards final distribution once all bills and final expenses have been paid.

Probate can be an intimidating experience for anyone that has never been through the process. As an experienced probate attorney, I can guide you through this legal maze.

Regardless of how minimal or complex you may feel the estate is, the Law Offices of John F. Williams, Jr. can assist you with your probate issues in a timely manner. Call today for a Free Consultation and I look forward to working with you on your estate planning.
