Attorney John F. Williams, Jr. Can Help You with Determination of Heirship and Probate
When there isn’t a possibility of locating a Will (holographic or attorney drafted) the Determination of Heirship is filed separately in Probate Court and separate of the petition for Administration. Unlike an Affidavit of Heirship, the Determination of Heirship must be dealt with through the Court system.
The Court will order the appointment of an attorney ad litem to represent the unknown heirs. The attorney locates and identifies heirs for the court and the administrator appointed to handle the affairs of the deceased individuals estate.
Once this has taken place, then the court will allow the probate process to move forward towards final distribution once all bills and final expenses have been paid.
