Another streamlined, more efficient method of probating a will is the process called Muniment of Title. In a Muniment of Title scenario, an Executor is not appointed, an inventory is not required to be filed, and a notice to creditors is not required to be published. This process is limited to a situation in which you are simply trying to Probate the will in order to transfer real estate (and certain other property) under the terms of the Will.
Additionally, while a full-blown probate is only available during the four-year period following the date of death, a Muniment of Title may be used after that period of time in some circumstances. Let us review your situation and determine the best method of probating your loved one's Will.
