
Our firm assists individuals with private party adoptions and are what are more commonly known as Step-Parent Adoptions. Our firm will handle the preparation of the legal documents that will be signed by the birth parents. We will file the lawsuits necessary to terminate the parent right of the biological parent or parents and to consummate the adoption. We even arrange for the issuance of the new birth certificate for your child.
Remember that in most Step-Parent Adoption suits, there has to filed a suit to terminate the non-custodial parent's right. This is something the court will only be willing to do if the non-custodial parent is in agreement and the court finds such a termination and adoption is in the best interest of the child or under certain specific circumstances spelled out in the Texas Family Code. The court must find that one of these allegations of abuse, abandonment or neglect is true and that termination of that relationship is in the best interest of the child. Having a Step-Parent able and willing to step in and adopt the child gives the court an alternative solution to provide a parent child relationship for the child and often will override the concern that the child is losing a parent as in situations without the corresponding adoption.
