The fundamental goal of the federal bankruptcy laws enacted by congress is to give debtors a financial “fresh start” from burdensome debts. The Supreme Court of the United States made this observation about the purpose of the bankruptcy laws in a 1934 decision, “It gives to the honest but unfortunate debtor…a new opportunity in life and a clear field for future effort, unhampered by the pressure and discouragement of preexisting debt.”

It is this backdrop in which the Bankruptcy Code exists and provides people the opportunity to either discharge and thereby eliminate their debt or to reorganize their debt in such a way that they are able to keep and protect the exempt assets for which they have worked so hard.

Bankruptcy is a fair, honest, legal, ethical way to deal with life suffocating debt such as stopping foreclosures in order to catch up on a mortgage, to stop repossessions to reorganize auto loans, to stop creditor calls and collection efforts, to stop lawsuits from either being filed or from continuing or to even stop IRS collection efforts in order to discharge and eliminate such debt or reorganize and payback without penalty IRS debt that is not dischargeable.
